Terms and Conditions (T&C) for the Use of the Platform “CheckMyTrailer”
1. General
1.1 These Terms and Conditions (T&C) govern the contractual relationship between iQnexxt Solutions GmbH, Thomas-Eßer-Straße 86, D-53879 Euskirchen, Germany (hereinafter referred to as “Provider”), and the users of the platform “CheckMyTrailer” (hereinafter referred to as “User”).
1.2 By registering on the “CheckMyTrailer” platform and using the corresponding app, the User accepts these T&C.
1.3 Deviating or supplementary terms and conditions of the User do not become part of the contract unless the Provider expressly agrees to their validity in writing.
2. Service Description
2.1 The “CheckMyTrailer” platform offers a track & trace solution for vehicles, enabling the tracking of location and various telematics data of vehicles in real-time.
2.2 The platform is accessed via a web-based application and a mobile app.
2.3 The exact features and functions of the platform are described on the Provider’s website at https://iqnexxt.solutions.
3. Registration and Conclusion of Contract
3.1 The use of the platform requires registration. Registration is only possible with user data previously provided by iQnexxt Solutions GmbH.
3.2 By registering, the User makes a binding offer to conclude a usage contract. The Provider accepts this offer by activating the user account.
3.3 Downloading the app and using the web portal automatically leads to the User’s acceptance of the T&C.
3.4 The User is obliged to keep access data confidential and to protect it from unauthorized access by third parties. The Provider is not liable for security incidents resulting from careless handling of passwords.
4. Use of the Platform
4.1 The User may only use the platform within the framework of legal provisions and these T&C.
4.2 The User is prohibited from misusing the platform, particularly by transmitting harmful software or by spying on or manipulating data.
4.3 The misuse of tracking data for personal surveillance is a criminal offense and will be reported.
4.4 Data on the platform is anonymized and subject to the provisions of the GDPR.
4.5 The Provider reserves the right to block or delete user accounts in case of violations of these T&C or legal provisions, especially in case of suspected data misuse.
5. Costs and Payment Terms
5.1 The use of the “CheckMyTrailer” platform may be subject to charges. The current prices and fees are available on the Provider’s website.
5.2 Payments are due immediately without deduction upon invoicing.
5.3 In case of payment default, the Provider reserves the right to block access to the platform.
6. Liability and Warranty
6.1 The Provider does not guarantee the constant availability of the platform. Technical disruptions, maintenance work, or force majeure may limit availability.
6.2 Data transmission may be delayed and depends on the mobile reception of the telematics devices.
6.3 The Provider is only liable for damages resulting from intentional or grossly negligent breach of duty.
6.4 The Provider does not guarantee the accuracy and completeness of the data recorded via the platform.
7. Data Protection
7.1 Protecting the personal data of Users is important to the Provider. All information regarding the processing of personal data is regulated in the Provider’s privacy policy.
7.2 The User consents to the collection, processing, and use of their personal data in accordance with the Provider’s privacy policy.
7.3 German law regarding the GDPR applies. The platform is hosted in the EU according to European security guidelines.
8. Duration and Termination
8.1 The usage contract is concluded for an indefinite period.
8.2 The User can terminate the contract at any time without giving reasons in text form.
8.3 The Provider can terminate the contract with a notice period of four weeks to the end of the month. The right to extraordinary termination remains unaffected.
9. Changes to the T&C
9.1 The Provider reserves the right to change these T&C at any time with future effect.
9.2 Changes to the T&C will be communicated to the User in a timely manner. If the User does not object to the changes within four weeks after receipt of the notification, the changes are deemed accepted.
10. Final Provisions
10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 The place of jurisdiction for all disputes arising from this contract is the registered office of the Provider.
10.3 Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by an effective provision that comes closest to the purpose of the invalid provision.
